سرنوشت ناپدیدشدگان اجباری در قلمرو کشور آلبانی شفاف سازی شود

خانواده های اسیران فرقه رجوی در استان اردبیل به کمیته کارشناسان کنوانسیون «حمایت از اشخاص در برابر ناپدیدسازی» نامه نوشتند.

به گزارش پایگاه خبری-تحلیلی فراق، خانواده های این افراد مدت‌هاست نگران و سرگردان پیگیر سرنوشت نزدیکان و عزیزان خود بوده و با نامه نگاری های بین المللی دنبال ارتباط با آنها می باشند.

متن نامه این خانواده ها که امروز توسط انجمن نجات مرکز استان اردبیل در اختیار «فراق» قرار گرفت، به شرح زیر است:

ریاست محترم کمیته کارشناسان کنوانسیون «حمایت از اشخاص در برابر ناپدیدسازی»

با احترام، مستحضر هستید که چند سالی است سازمانی تحت عنوان «سازمان مجاهدین خلق» با سوابق سیاه ارتکاب تروریسم و جنایات خشونت بار ضدانسانی در چارچوب یک توافق چندجانبه از کشور عراق به خاک آلبانی عزیمت کرده و اعضای خود را در کمپ های موجود در آن کشور مستقر نموده است.

متاسفانه از آنجا که این گروه مدعی آزادی خواهی دارای «ماهیت فرقه ای» و قوانین حیرت آور و بشدت سختگیرانه برای اعضای نگون بخت خود می باشد محدودیتهای عجیب و بعضا طاقت فرسایی را برای جزیی ترین امور زندگی اعضا (حتی در شخصی ترین مسائل ایشان اعم از رفت و آمد و ارتباطات انسانی و حتی امیال و تمنیات جنسی ایشان) وضع کرده است و به رغم شعارهای آزادی خواهی خود به آنها آموزش های ضدانسانی شکستن دست، بریدن گلو و درآوردن چشم با انگشت می دهد. در این خصوص نظر شما را به گزارش رسانه های مطرح اروپایی همچون اشپیگل جلب می نماییم.

این روند ضدبشری سبب گردیده تا طاقت برخی از اعضا به سرآمده و ضمن ابراز مخالفت های خود با محدودیت های وضع شده و رفتارهای ضدانسانی رهبران سازمان، میل خود برای جدایی از سازمان را اعلام نمایند. با این حال با نهایت تاسف باید گفت که دولت آلبانی در یک روند عامدانه، سیستماتیک و طراحی شده و در همدستی کامل با سازمان مجاهدین خلق مبادرت به ناپدیدسازی اجباری اعضای جدایی خواه نموده و طیف گسترده ای از اقدامات ممنوعه مطابق کنوانسیون بین المللی حمایت از افراد در مقابل ناپدیدسازی اجباری از جمله بازداشت خودسرانه بدون کوچکترین اطلاعی به اطرافیان و نزدیکان فرد نموده به گونه ای که در بسیاری موارد حتی بیم قتل قربانیان و مبهم ماندن ابدی سرنوشت ایشان نیز می رود.

این اقدامات ممنوعه و ضدانسانی در حالی صورت می گیرد که این دولت عضو کنوانسیون بین المللی حمایت از افراد در مقابل ناپدیدسازی اجباری بوده و فراتر از آن، اعلامیه پذیرش صلاحیت این کمیته براساس ماده ۳۱ کنوانسیون را نیز صادر نموده است. براین اساس نویسندگان این درخواست، اعضای انجمن نجات استان اردبیل –جمعی از خانواده های اعضای گرفتار در سازمان مجاهدین خلق از استان اردبیل ایران- بعنوان یک تشکل مردم نهاد و غیردولتی که براساس ضرورت کمک به اعضای گرفتار در فرقه مجاهدین خلق تشکیل شده است نظربه اینکه؛

• دولت آلبانی هیچ پاسخ روشن و متقاعدکننده ای به خواسته های مشخص و بدیهی خانواده های قربانیان ناپدیدسازی اجباری نداده و درخواست های خانواده ها با بی تفاوتی مقامات این دولت عملا بی پاسخ مانده است و
• خانواده های این افراد مدت هاست نگران و سرگردان پیگیر سرنوشت نزدیکان و عزیزان خود هستند و
• به دلیل قوانین و مقررات موضوعه این کشور در منع صدور ویزا برای اتباع ایرانی عملا امکان طرح دعوا و رجوع مقدماتی به محاکم داخلی این کشور از اساس منتفی می باشد
• اقدامات متضمن ناپدیدسازی اجباری به یک روند منسجم، سیستماتیک و برنامه ریزی شده با مشارکت و همدستی دولت آلبانی و رهبران سازمان مجاهدین خلق بدل گشته است و بیم وقوع این حوادث در آینده نیز بسیار محتمل است
• دلایل موجه و روشنی در انجام این اقدامات از سوی نیروهای دولت آلبانی وجود داشته و انتساب این اقدامات به دولت آلبانی بر مبنای مجموعه ای از دلایل و شواهد معقول صورت می گیرد که به آن مرجع ارائه خواهد شد

علیهذا نظر به مراتب فوق از اعضای محترم آن کمیته تقاضا داریم نسبت به بررسی دقیق درخواست اینجانبان در رسیدگی به امور ناپدیدشدگان اجباری در قلمرو کشور آلبانی و مسئولیت بین المللی این کشور در پاسخگویی نسبت به موارد مزبور و شفاف سازی سرنوشت ناپدیدشدگان اجباری اقدامات لازم را اتخاذ فرمایید.

In the name of God

The honorable experts of the UN Committee on enforced Disappearances (CED)

Yours sincerely, you are aware that For many years now, an organization known as “People`s Mojahedin Organization of Iran (MEK, PMOI or MKO) with a long history of committing terrorism and violent crimes against civilians has left Iraq toward Albania within the framework of a multilateral agreement and has settled its members in the camps established there.

Unfortunately, as this group has sectarian/cult nature and has shocking and extremely strict laws applicable for its unfortunate members, thus it imposes strange and sometimes overwhelming restrictions regarding to the smallest/least important/most detailed issues of members lives (even in their most private matters including right to movement of them, human relations and even their sexual desires or emotional matters). In spite of slogans on right to human freedom by their leaders, this organization (cult/sect in more precise sense) has given (and is giving) them series of inhuman teachings including breaking hands, cutting throats and removing eyes with fingers. In this regard, we draw your attention to the reports of major European media such as BBC or Der Spiegel. 

This inhumane process has caused some members to lose their strength, while expressing their opposition to the restriction imposed and the inhumane behaviors by MEK`s leaders, they express their desire to leaving the organization. However, it must be noted that Albanian officials, in a deliberate, systematic and planned process, in full cooperation/complicity with MEK`s leaders, has attempted to the enforced disappearances of separatist/opposite members. And has committed a wide range of prohibited acts under convention against enforced disappearances 2006 including arbitrary detention without legal base or any information to detained persons or his relatives.  So that ,in some cases,  there is concerns about killing of disappeared persons and remaining unclear their fate eternally.

These prohibited inhumane acts take place while Albania is a state party of the international convention for the protection of all persons from enforced disappearances, moreover, this state has issued a declaration on recognizing the competence of the committee on enforced disappearances (CED) pursuant to article 31 of the Convention. According to this, authors of this petition –the members of Nejat Association (consisting of families of MEK`s members from Ardabil Province of Islamic Republic of Iran)- as a non-governmental entity established on the necessity to help MEK`s members, demand؛   

Considering that

۱- Albanian officials have not given any clear and convincing answer to the specific and obvious demands of the families of victims of enforced disappearance, and their demands have remained actually unanswered due to indifferences of Albanian officials؛

۲- The families of these persons have been worried and confused about the fate their loved ones for a long period؛

۳- Due to the laws and regulations of Albania in banning the issuance visa for Iranian nationals, its practically impossible to filing a case and preliminary referral to the domestic courts of Albania (the Rule of Prior Exhaustion of Domestic Remedies).

۴- Activities involving enforced disappearance of persons have become to a deliberate, systematic and planned process with the participation/complicity  between of the Albanian officials and MEK`s leaders, thus its possible the occurrence of these inhumane crimes in the future.

۵- There are reasonable and definite reasons that these offences are committed by Albanian forces, so that attribution of these illegal activities to Albania is based on a series of sufficient and convincing evidences that will be presented to committee (CED).

Finally, according to aforementioned items, we demand the honorable members of CED to taking the necessary measures for careful addressing of issues of enforced disappearance of persons in Albania`s territory and international responsibility of this state to responding to these cases under customary and treaty international law, and clarifying the fate of disappeared persons too.
